Debarment

In terms of Section 69 of the Public Procurement and Disposal of Public Assets (General) Regulations, 2018, the Authority is empowered, on the recommendations from a Procuring Entity or the Monitoring and Evaluation Department of the Authority, following an investigation carried out by the department to debar or black list a bidder or contractor guilty of prohibited conduct from engaging in any public procurement or disposal process for a period determined by the Authority.

Notice to suspended or debarred bidder or contractor shall be made in writing in term of Section 75 of the Procurement Regulations.

At the end of the period for which a bidder or contractor has been suspended under, the Authority shall remove the name of the bidder or contractor from the debarred list in terms of Section 77 (1) & (2) of the Procurement Regulations.

Solutions Motors (Pvt) Ltd

in terms of section 74 (1) (e) of the PPDPA (General) Regulations, the bidder is permanently debarred from participating in public procurement effective from 27 January 2023.

 

White Ox Trading (Pvt) Ltd

Due to the Respondent’s failure to carry out the remedial plan issued in the determination of 25 March 2023 within three month suspension period, the committee’s determination in terms of section 74 (1)(d) is to temporarily debar the Respondent from participation in public procurement proceedings for period of twenty four (24) months from the date of determination.

The sanction on the Respondent is temporary debarment from participating in public procurement proceedings due to non-delivery of paid for generator for three (3) years reckoned from the date of this determination in terms of section 74(1)(d) of the PPDPA (General) Regulations.

The sanction on the Respondent is suspension from participating in public procurement proceedings due to non-delivery of paid for goods for twelve (12) months reckoned from the date of this determination with a remedial plan for the Respondent to effect full delivery of the seven (7) outstanding vehicles before the 30th of June 2024, which will reduce the suspension period to nine (9) months in terms of section 74(1)(c) of the PPDPA (General) Regulations.

The Committee having found the Respondent, guilty of prohibited conduct, the sanction imposed on the Respondent shall be in terms of section 74(1)(d) of the PPDPA (General) Regulations, temporary debarment by debarring the Respondent from participation in procurement proceedings for a period of 20 months.

The sanction on the Respondent is suspension from participating in public procurement due to non-completion of contracted works for nine (9) months reckoned from the date of this determination with a remedial plan for the Respondent to effect full completion of works within four (4) months of this determination which will reduce the suspension period to six (6) months from date of determination in terms of section 74(1)(c) of the PPDPA (General) Regulations.

The Committee having found the Respondent, guilty of prohibited conduct, the sanction imposed on the Respondent shall be in terms of section 74(1)(c) of the PPDPA (General) Regulations, suspension of the Respondent from participation in procurement proceedings for a period of 12 months, with a remedial plan that the 12 months would be wholly suspended at the fulfilment of contractual obligations.

The Committee having found the Respondent guilty of prohibited conduct, the sanction imposed on the Respondent shall be in terms of section 74(1)(c) of the PPDPA (General) Regulations, that is to say, suspension of the Respondent from participation in procurement proceedings for a period of six (6) months with a remedial plan for the Respondent to deliver the laptops within one (1) month of this written determination, which will reduce the period to three (3) months

Due to mitigating factors that the Respondent to adhere to their own delivery commitments to the Applicant, and the fact that the Respondent has been found guilty of prohibited conduct in at least two other cases, the sanction on the Respondent is temporary debarment for a period of 36 months from the date of written determination from participating in public procurement due to non-delivery of a fully paid for vehicle in terms of section 74(1)(d) of the PPDPA (General) Regulations.
